1. Introduction

GOVA is South Africa's trusted online directory connecting transport companies (Transporters) with verified roadside service providers (Providers). By accessing or using the GOVA platform, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the platform.

2. Definitions

• Platform: The GOVA website, mobile applications, and all related services.
• Provider: A registered roadside service provider offering services listed on the platform.
• Transporter: A transport company or individual using the platform to find and contact Providers.
• User: Any person or entity accessing or using the platform, including Providers and Transporters.
• Listing: A Provider's business profile displayed in the GOVA directory.
• Enquiry: A message or contact request sent by a Transporter to a Provider through the platform.

3. Eligibility

You must be at least 18 years of age and legally capable of entering into binding contracts under South African law. By registering or using the platform, you confirm that all information provided is accurate, complete, and up to date.

4. Account Registration

You are responsible for maintaining the confidentiality of your account credentials. All activity conducted under your account is your responsibility. You agree to notify GOVA immediately if you suspect any unauthorised access or use of your account. GOVA reserves the right to suspend or terminate accounts that violate these terms.

5. Provider Listings

Providers are solely responsible for the accuracy and completeness of their listings. All Providers must hold the necessary licences, permits, and insurance required to operate legally in South Africa. GOVA does not independently verify the credentials, qualifications, or compliance of Providers. Transporters are encouraged to conduct their own due diligence before engaging any Provider.

6. Subscription Plans and Payments

All subscription fees are quoted in South African Rand (ZAR) and are exclusive of Value-Added Tax (VAT), which will be added where applicable. GOVA reserves the right to update pricing with reasonable notice. Subscriptions are non-refundable except as required by the Consumer Protection Act 68 of 2008 or other applicable South African consumer protection legislation.

7. Prohibited Conduct

You may not:

• Provide false, misleading, or inaccurate information.
• Use the platform for any unlawful purpose or in violation of South African law.
• Scrape, harvest, or collect data from the platform using automated means.
• Harass, threaten, or abuse other Users.
• Attempt to gain unauthorised access to any part of the platform or other Users' accounts.
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity.

8. Intellectual Property

All content on the GOVA platform — including text, graphics, logos, images, software, and design — is owned by or licensed to GOVA and is protected under South African intellectual property law. You may not reproduce, distribute, modify, or create derivative works from any content without prior written permission from GOVA.

9. Disclaimer of Warranties

The platform is provided on an "as is" and "as available" basis. GOVA makes no representations or warranties of any kind, express or implied, regarding the accuracy, reliability, or availability of the platform or the services listed. GOVA does not endorse or guarantee any Provider or the quality of their services.

10. Limitation of Liability

To the fullest extent permitted by South African law, GOVA shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the platform. GOVA's total liability for any direct damages shall not exceed the total fees paid by you to GOVA in the three (3) months preceding the event giving rise to the claim.

11. Privacy and POPIA

Your use of the platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information in compliance with the Protection of Personal Information Act 4 of 2013 (POPIA). You can view our full Privacy Policy at /privacy.

12. Amendments

GOVA reserves the right to update or modify these Terms & Conditions at any time. Material changes will be communicated via email or through a notice on the platform. Your continued use of the platform after such changes constitutes your acceptance of the updated terms.

13. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from or relating to these terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
